UNDERSTANDING “PROTECTED” VA DISABILITY RATINGS

Some VA disability ratings are considered “protected,” meaning the Department of Veterans Affairs (VA) cannot reduce or revoke them in the future. This protection exists to provide long-term stability for veterans whose service-connected conditions meet specific criteria.

Under certain circumstances, Congress allows some service-connected conditions to bypass periodic reevaluations.

This can occur in two ways:

  1. Time-Based Protection: Some ratings automatically become protected after a certain number of years.

  2. Condition-Based Protection: Certain conditions are inherently protected due to the nature or permanence of the disability.

Protected ratings ensure that veterans receive consistent benefits without the concern of future reductions, offering peace of mind and financial security.

If you’re navigating the VA disability process and want to learn more about how protected ratings may apply to your case, book a consultation today.
